Use and safety
Products sold by NoxTek™ must be used in accordance with the instructions, warnings, limitations, and intended uses stated on the product page, packaging, manual, or any document provided.
The user remains responsible for use, installation, maintenance, handling, and compliance with applicable safety instructions.
Certain products may present risks if they are used improperly, modified, damaged, or used in an unsuitable environment. Where relevant, products must be kept out of the reach of children.
Batteries and charging
Where applicable, use only suitable charging accessories and follow the instructions provided.
Where a NoxTek™ product is designed with a removable battery, normal replacement of that battery is permitted. NoxTek™ recommends using a battery tested and approved by NoxTek™ for the product concerned to ensure compatibility with its specifications.
NoxTek™ cannot guarantee the compatibility, safety, or behaviour of a battery that has not been tested and approved by NoxTek™. Damage resulting from a battery that is incompatible, modified, damaged, has unsuitable specifications, or is used contrary to the instructions is not covered by the limited warranty.
Immediately stop using a product or battery in the event of overheating, an unusual odour, swelling, leakage, visible damage, abnormal behaviour, or any sign of failure.
NoxTek™ cannot be held liable for damage resulting from non-compliant use, an unsuitable charger, modification of the product, unauthorized repair, or use of an incompatible battery.
NoxTek™ validation and the NX-EXP approach
NoxTek™ applies an internal selection, inspection, and validation approach, including, as applicable, shop testing, observations under real-world conditions, and comparative measurements.
These validations are intended to better inform the customer, reduce uncertainty at the time of purchase, and confirm the product’s consistency with its intended use. However, they do not constitute a guarantee of performance in every possible situation.
Observed results may vary depending on the environment, installation, use, maintenance, temperature, humidity, wear, state of charge, accessories used, and other external factors.
Information and recommendations
The information and recommendations provided by NoxTek™ are general in nature and are intended for normal use of the products.
For any special installation, critical application, hazardous environment, specialized professional use, or situation that may involve the safety of people or property, consulting a qualified professional is recommended.
Accuracy of information
NoxTek™ strives to provide accurate, useful, and current information. Despite this, errors, omissions, variations, or differences in presentation may occur.
Images, renderings, colours, finishes, accessories, packaging, and versions presented on the website are provided for reference and may vary by batch, supplier, product update, or display conditions.
Limited warranty and legal warranties
Unless otherwise stated on the product page, NoxTek™ products are covered by a 1-year limited warranty against manufacturing defects under normal use.
This limited warranty does not cover:
- normal wear and tear;
- damage caused by misuse;
- accidental damage;
- excessive impacts or abnormal conditions;
- water damage where the product is not designed or certified for such use;
- modifications, unauthorized repairs, or work on internal components;
- the use of incompatible or unsuitable accessories or batteries;
- damage resulting from failure to follow the instructions.
Normal replacement of a removable battery with a battery tested and approved by NoxTek™ for the product concerned is not considered an unauthorized modification.
This limited warranty is in addition to applicable legal warranties and does not limit the consumer rights provided by applicable law. In Quebec, the law provides, in particular, that goods must be fit for their intended purpose for a reasonable period of time.
Limitation of liability
To the extent permitted by applicable law, NoxTek™ and Solutions NoxTek cannot be held liable for indirect, incidental, special, or consequential damages related to the use of or inability to use a product, including loss of use, revenue, data, time, or opportunities.
To the extent permitted by applicable law, the total liability of NoxTek™ and Solutions NoxTek for any claim related to a product will not exceed the amount paid for the product concerned.
This limitation does not apply where prohibited by law.
Availability of parts, services, and information
Depending on the type of product, certain parts, repair services, or maintenance information may be available, partially available, or unavailable. Where required by applicable law, NoxTek™ will provide relevant information concerning the availability of parts, services, or maintenance information. In Quebec, certain rules apply to the availability of parts, services, and information necessary for the maintenance or repair of certain goods.
