These Terms of Use (“Terms”) govern access to the noxtek.ca website and use of the online store operated by Solutions NoxTek (“NoxTek™,” “we,” “us,” or “our”).
By browsing the website or making a purchase, you agree to these Terms, subject to the rights and protections provided by applicable law.

We may update these Terms to reflect changes to our practices, our store, or applicable law.
The current version is posted on this page with the date it was updated.
2. Products, information, and availability
Product descriptions, images, specifications, technical data, and related content are provided for informational purposes.
Despite our efforts, errors, omissions, or minor variations may occur, including with respect to colours, finishes, accessories, versions, packaging, or technical data.
Certain products may be offered in limited quantities and may be changed, replaced, or removed from the website without notice, subject to orders already accepted and rights provided by applicable law.
3. Prices, taxes, and payments
Prices are shown in Canadian dollars (CAD), unless otherwise stated.
Applicable taxes, shipping costs, and other applicable charges, if any, are displayed at checkout before payment is confirmed.
Accepted payment methods are those displayed at the time of payment.
4. Orders and cancellations
An order may be changed or cancelled at the customer’s request only if it has not yet been processed or shipped.
We may contact the customer where information is incomplete, incorrect, or required to process the order.
In certain cases permitted by applicable law, we may refuse or limit an order, including in the event of reasonable suspicion of fraud, abusive use of the website, an obvious error, or an issue preventing the secure processing of the transaction.

Delivery conditions, applicable costs, and estimated time frames are described in our Shipping Policy.
Once the parcel has been handed over to the carrier, delivery times and handling are the carrier’s responsibility, subject to the protections provided by applicable law.
In the event of a delay, lost parcel, or delivery issue, we will assist the customer with the appropriate process depending on the situation.
6. Returns and refunds
Return conditions and procedures are described in our Return and Refund Policy.
Certain items may not be eligible for a voluntary return, including personalized products, final-sale items, and items that have been used, are incomplete, or are damaged, subject to the rights and remedies provided by applicable law.
7. Warranty and out-of-warranty replacement
Unless otherwise stated on the product page, NoxTek™ products are covered by a 1-year limited warranty against manufacturing defects under normal use.
After this period, a NoxTek™ product that has become unusable may be eligible for the NoxTek™ Out-of-Warranty Replacement Program. When a request is eligible, the program provides a 25% discount off the current retail price of an eligible replacement unit, subject to proof of purchase, validation of the request, and availability of the product or a suitable equivalent.

The limited warranty and this program are in addition to applicable legal warranties and do not limit consumer rights provided by applicable law.
8. Safe use of products
Products must be used in accordance with the instructions, warnings, limitations, and intended uses stated on the product page, packaging, manual, or any document provided.
The user remains responsible for use, installation, handling, maintenance, and compliance with applicable safety instructions.
9. Limitation of liability
To the extent permitted by applicable law, NoxTek™ and Solutions NoxTek cannot be held liable for indirect, incidental, special, or consequential damages resulting from the use of or inability to use a product, including loss of use, revenue, data, time, or opportunities.
Where applicable, and to the extent permitted by applicable law, the total liability of NoxTek™ and Solutions NoxTek for any claim related to a product will not exceed the amount paid for the product concerned.
This limitation does not apply where prohibited by law.
10. Use of the website
You agree not to use the website for any illegal, fraudulent, abusive, or harmful purpose.
You also agree not to attempt to compromise the security, integrity, availability, or proper operation of the website.
11. Intellectual property
The store’s original content and elements, including text, photographs, videos, logos, trademarks, graphic elements, documents, guides, technical sheets, illustrations, original layout and interface elements, and, where applicable, custom code, are protected by applicable intellectual property rights and belong to Solutions NoxTek or their respective owners.
Any reproduction, adaptation, distribution, commercial exploitation, or substantial reuse of these elements without prior authorization is prohibited, except to the extent permitted by law.

The website may contain links to third-party websites, services, or platforms.
NoxTek™ is not responsible for the content, practices, policies, or operation of those external websites or services.
13. Governing law
These Terms are governed by the applicable laws of the province of Quebec, Canada, unless otherwise required by law.
